Terms of Service

1. Agreement to Terms

By purchasing or using AI App Factory ("the Product"), you agree to be bound by these Terms of Service. The Product is provided by Product Engineer ("we", "us", or "our"). If you do not agree to these terms, please do not purchase or use the Product.

2. Product Description

AI App Factory is a digital product consisting of software boilerplate code, templates, documentation, and related materials designed to help developers build and launch mobile applications. The Product is delivered digitally — upon purchase, a private repository is generated in your own GitHub account from our prebuilt template.

3. License Grant

Upon purchase, we grant you a non-exclusive, non-transferable license to use the Product subject to the following terms based on your purchased tier:

• Starter Tier: Personal use license for one individual. You may use the Product to build and launch applications for personal or commercial purposes. You may not redistribute, resell, or share the source code.
• Pro Tier: Personal use license for one individual with extended features. Same usage rights as Starter, with additional templates and support materials included.
• Team Tier: License for up to 5 team members within a single organization. Team members may use the Product for the organization's projects. Redistribution or resale of the source code is prohibited.

4. Intellectual Property

The Product, including all source code, documentation, and related materials, is the intellectual property of Product Engineer. Your purchase grants you a usage license, not ownership of the intellectual property. You own the applications you build using the Product.

5. Payment Terms

The Product is sold as a one-time purchase. Payments are processed through Lemon Squeezy (for USD transactions) and PortOne (for KRW transactions). All prices are displayed at the time of purchase and are subject to change without prior notice for future purchases. Your purchase price is locked at the time of transaction.

6. Delivery

Upon successful payment, you connect your GitHub account and generate a private repository in your own account from our prebuilt template. The generated repository is yours to own and manage. Delivery is automated and typically occurs within minutes. If you experience any issues with delivery, please contact us at support@productengineer.info.

7. Prohibited Uses

You may not:

• Redistribute, resell, or sublicense the Product source code
• Share the generated repository or its contents with unauthorized users
• Use the Product to create a competing product or service that sells similar boilerplate/template kits
• Remove or alter any proprietary notices or labels on the Product
• Share or transfer template repository access credentials or organization membership with unauthorized users
• Clone or fork the template repository for purposes other than updating your licensed copy

8. Updates and Support

Since the repository is generated in your own GitHub account, you retain full ownership and access permanently. Product updates (bug fixes, new features, and improvements) are delivered to your repository for 1 year from the date of purchase. After the 1-year update period, your repository and all previously delivered materials remain yours, but no further updates are guaranteed. Support is provided via email at support@productengineer.info. We aim to respond to support inquiries within 2 business days.

Pro and Team Tier Update Access: Pro and Team tier purchases include read-only access to the source template repository via GitHub organization membership for receiving updates. This access is personal and non-transferable. You may use this access solely to pull updates into your own licensed repository. We reserve the right to revoke template repository access if these terms are violated or upon license termination.

9. Limitation of Liability

The Product is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Product will meet your specific requirements or that it will be error-free. In no event shall Product Engineer be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Product. Our total liability shall not exceed the amount you paid for the Product.

10. Termination

We reserve the right to revoke your license if you materially violate these Terms of Service. We will provide written notice of the alleged violation and allow 14 days to cure the breach before termination takes effect. Upon termination, you must cease all use of the Product and delete any copies in your possession. Refund eligibility upon termination is governed by our Refund Policy.

11. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Product after changes constitutes acceptance of the modified terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions. However, if you are a consumer residing in the United States, nothing in these terms limits your rights under applicable U.S. federal or state consumer protection laws, and you may bring claims in your local jurisdiction as permitted by applicable law.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
